MOST motorcycle insurance companies in CA will NOT write policies for anything
higher than the state mins, and the major companies (Allstate, etc.) won't
write policies on sportbikes because they traditionally have high loss
profiles. So this guy probably has a min coverage policy from a motorcycle
insurance company.
No doubt, the Ducati will have performed $5K worth of damage to the other car
before reaching yours. His insurance company can just shrug at you, turn
their pockets inside-out, and walk away. Leaving YOUR insurance company to
pay for all the damage caused by this other guy, and (possibly?) forcing your
rates to go up. Granted, your company can legally go after the guy and
reposses his Explorer or something, but often the hassle of a court case is
more trouble than their willing to take. It's easier to just raise your
rates!
